By using Chartiny, you represent and warrant that you meet these requirements.

2. Nature of Service

Chartiny provides educational, analytical, and research tools related to options trading and market strategy backtesting.

• Chartiny does not provide investment advice
• Chartiny is not a SEBI-registered investment advisor
• Chartiny does not execute trades, handle funds, or place orders on your behalf

All content and outputs are for informational and educational purposes only.

3. No Financial Advice

Nothing on Chartiny constitutes:

• Investment advice
• Trading advice
• Financial, legal, or tax advice
• A recommendation to buy, sell, or hold any security or derivative

You are solely responsible for your trading decisions and outcomes.

4. User Accounts

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your login credentials
• Be fully responsible for all activity under your account

Chartiny is not liable for unauthorized access resulting from your failure to secure your account.

5. Subscriptions, Pricing & Taxes

• Chartiny may offer paid subscription plans with fixed durations
• Subscriptions do not auto-renew
• Users must manually purchase a new plan after expiry
• A month is defined as 30 days
• All prices are exclusive of applicable taxes unless stated otherwise
• 18% GST is charged on all paid subscriptions as per Indian law

All purchases are governed by the Refund Policy.

6. No Refunds

All subscription purchases are final and non-refundable.

• No refunds for partial usage, unused time, or early expiration
• No refunds for dissatisfaction, non-usage, or change of mind
• GST once charged is non-refundable

By purchasing a subscription, you explicitly agree to this policy.

7. Acceptable Use

You agree not to:

• Use Chartiny for any unlawful or fraudulent purpose
• Attempt to reverse-engineer, decompile, or extract source code
• Scrape, crawl, or systematically download platform data
• Bypass security, rate limits, or access controls
• Interfere with or disrupt the Platform or servers

Violation may result in immediate suspension or termination.

8. Intellectual Property

All rights, title, and interest in:

• Software
• Algorithms
• Designs
• Branding
• Content and documentation

belong exclusively to Chartiny.

You retain ownership of strategies, inputs, and configurations you create using the Platform, but Chartiny retains ownership of the underlying system and computations.

9. Data & Accuracy Disclaimer

• Market data, calculations, and backtest results may contain errors, delays, or omissions
• Past performance shown through backtests does not guarantee future results
• Hypothetical or simulated results may differ significantly from real-world trading

You acknowledge and accept these limitations.

10. Service Availability & Changes

• Chartiny is provided on a best-effort basis
• We do not guarantee uninterrupted, error-free, or continuous availability
• Features, pricing, or functionality may change, be modified, or discontinued at any time

We are not liable for any loss resulting from such changes.

11. Account Suspension & Termination

We may suspend or terminate your access, without notice, if:

• You violate these Terms
• You misuse the Platform
• You attempt to harm Chartiny or other users

Termination does not entitle you to any refund.

12. Limitation of Liability

To the maximum extent permitted by law, Chartiny shall not be liable for:

• Trading or investment losses
• Loss of profits, data, or opportunity
• Data inaccuracies or calculation errors
• Service interruptions or downtime
• Indirect, incidental, or consequential damages

Your use of Chartiny is entirely at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Chartiny from any claims, losses, liabilities, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your trading or investment decisions

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of courts in India.

15. Changes to Terms

We may update these Terms from time to time.

• Continued use of Chartiny after changes constitutes acceptance of the updated Terms
• The latest version will always be available on the Platform
